Legal analysis: New York joins lawsuit against Trump administration’s DEI order in schools

NEW YORK (WRGB) — Attorney General Letitia James, along with attorneys general from other states, has filed a challenging the that aim to remove diversity, equity, and inclusion (DEI) initiatives from public K-12 schools. However, the Trump administration argues that DEI initiatives provide unfair advantages to certain races over others, rather than rewarding merit.

Attorney Leslie Silva of , commented on the potential impact of the case, stating, "We did see a similar lawsuit get an early order to prevent any funding being withheld from schools so it's also possible that we'll see something like that here as well… The Executive Branch does not have the authority to withhold funds or issue new demands on funds that Congress has already approved." Silva noted that the administration's executive order is heavily influenced by a Supreme Court case against Harvard, which dealt with race in college admissions.

She said the White House is attempting to broaden that ruling to encompass all education sectors.
